These Terms of Service govern your use of the MOVO-X Malaysia platform provided by MOVO-X Sdn Bhd (“we”, “us”, “our”). By subscribing to or using the service, you agree to these terms.
These Terms of Service are governed by the laws of Malaysia. Any dispute arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of Kuala Lumpur, Malaysia.
MOVO-X Malaysia (MOVO-X Sdn Bhd) provides SaaS hospital queue management, patient self check-in kiosk software, and related clinical operations tools. The service is delivered via web application (malaysia.movo-x.com) and Android-based kiosk hardware.
Subscriptions are available on monthly or annual terms, denominated in Malaysian Ringgit (RM). Annual subscriptions receive a 15% discount. Subscriptions auto-renew unless cancelled with 30 days' written notice before the renewal date. All invoices are issued in RM and comply with Malaysian tax requirements. Late payment incurs a 1.5% monthly late fee.
The MOVO-X service may only be used by licensed healthcare facilities — hospitals, specialist centres, and primary care clinics operating in Malaysia. The customer must comply with the Personal Data Protection Act 2010 (PDPA 2010), the Private Healthcare Facilities and Services Act 1998 (PHFSA 1998), and all other applicable Malaysian laws and regulations.
The customer (clinic or hospital) is the Data User in respect of patient personal data collected via the MOVO-X kiosk and queue management system. The customer is responsible for: (a) ensuring valid PDPA 2010 consent is obtained from each patient before deploying the kiosk; (b) maintaining the PDPA 2010 consent notice in current and accurate form; (c) responding to patient data subject access requests within the timeframes required by PDPA 2010. MOVO-X Sdn Bhd acts as a Data Processor on behalf of the customer.
Uptime commitments vary by tier. Tier B: 99.9% monthly uptime. Tier C Enterprise: 99.95% monthly uptime with P1 incident response under 1 hour. Scheduled maintenance windows (typically Sunday 2am–4am MYT) are excluded from uptime calculations. Detailed SLA terms are provided in the enterprise service agreement.
MOVO-X Sdn Bhd processes personal data on behalf of the customer as described in the Privacy Policy and Data Processing Agreement. Patient NRIC numbers are stored only as SHA-256 hashes — raw IC numbers are never stored. All data is stored in ASEAN-resident infrastructure (Supabase Singapore and KL regions). Clinical medical records are not stored by MOVO-X.
MOVO-X Sdn Bhd's total liability under these terms is capped at the total subscription fees paid by the customer in the 12 months immediately preceding the event giving rise to the claim. MOVO-X Sdn Bhd is not liable for indirect, consequential, or punitive damages, including loss of patient data resulting from the customer's failure to maintain PDPA 2010 compliance.
Either party may terminate with 30 days' written notice. MOVO-X Sdn Bhd may terminate immediately for: non-payment (> 14 days overdue), material breach, or regulatory violation. Upon termination, MOVO-X Sdn Bhd will provide a full data export within 14 days and delete customer data within 30 days (subject to mandatory retention obligations under PDPA 2010).
The MOVO-X platform, software, and all related intellectual property remain the exclusive property of MOVO-X Sdn Bhd. The customer is granted a limited, non-exclusive, non-transferable licence to use the service for the term of the subscription.
MOVO-X Sdn Bhd may amend these terms with 30 days' notice delivered via email to the registered account administrator. Continued use of the service after the notice period constitutes acceptance of the amended terms.
